Due to the emergency legislation passing through the Scottish Parliament, which amended Criminal Procedure Act 1995, we have updated the legal guide. Essentially, if you are detained you may be held for 12 hours, instead of 6, and have the right to see a solicitor before you are questioned. It also allows this period to be extended in certain circumstances. This new information is available here.

The Scottish Activists' Legal Project is run by volunteers who are not legal experts. If in doubt take legal advice on the specifics of your situation from a solicitor. Our briefings only relate to the law in Scotland. For information on the law in England and Wales see the Activist Legal Project website. If you see any errors in our briefings or we have missed any changes in the law then please contact us.
